ISLAMIC PENAL LAW IN THE INDONESIAN LEGAL SYSTEM: RADICAL, MODERATE AND LIBERAL MUSLIMS' RESPONSE TO THE DRAFT OF KITAB UNDANG-UNDANG HUKUM PIDANA 2004

My five months' stay at NIAS allowed me to draft five of six preliminary chapters of my book on Islamic Penal Law in the Indonesian Legal System. I will continue work on the rest of the draft and several other aspects of the book in my home institution. I carried out my field research in Indonesia on how eight different Muslim groups in Indonesia received the draft of the Indonesian Criminal Code 2004. While I was starting to write at NIAS, I produced a draft version in 2008. The topic is current, dealing with the issue of legal thought in Indonesia and in particular on Islamic Law which cannot be seen from only the field of Islamic studies. Political as well as social and historical aspects are also relevant angles to be included in the discussion. Here, I also benefited from NIAS fellows specialised in political science, history and social anthropology. The way NIAS provides its fellows the space to use their time to work without a great number of formal obligations, creates a conducive academic milieu that enabled me to keep writing and to finish the job in due time.
